The surviving spouse of a person who dies domiciled in Florida has the right to claim a portion of the deceased spouse’s estate known as the “elective share.” The elective share is an amount equal to 30% of the elective estate.

This is one of the most complex and misunderstood areas of Florida law and requires a thorough understanding of the laws governing elective share.  Mr. Garten has written and lectured extensively on Florida’s elective share, and has the requisite knowledge and experience to recover the full amount of your elective share.
